Welcome to OtzTones (the “Platform”). These Terms of Service (“Terms”) govern your access to and use of OtzTones’ services—including video game streaming, gaming commentary, reviews, podcasts, websites, merchandise, and related services (collectively, the “Services”). By accessing, streaming, submitting content, or interacting with the Services, you agree to comply with these Terms.

If you do not agree, you must discontinue use immediately.

  • We do not guarantee uninterrupted access.

2. USER SUBMISSIONS & CONTENT RIGHTS

2.1 Ownership of User-Submitted Content
By submitting comments, reviews, messages, voice recordings, images, gameplay clips, testimonials, or any other material (“User Content”) to OtzTones, you agree:

  1. Full Usage Rights: You grant OtzTones an unrestricted, irrevocable, worldwide, royalty-free, sublicensable, and perpetual license to use, modify, distribute, reproduce, adapt, publish, perform, translate, display, and create derivative works from your User Content across all platforms.

  2. No Compensation: You waive any right to payment, royalties, or attribution for submitted User Content.

  3. Editing Rights: We may edit or adapt User Content to fit the style and needs of OtzTones.

  4. No Obligation to Use: Submission does not guarantee your User Content will be used.

2.2 Prohibited Submissions
Users may not submit content that:

  • Contains false, defamatory, obscene, threatening, or unlawful material.

We reserve the right to refuse or remove User Content at our discretion.

  • All OtzTones content (streams, podcasts, reviews, videos, text, logos, graphics, merchandise designs) is the intellectual property of OtzTones.

  • Content is protected under U.S. copyright, trademark, and intellectual property law.

  • Game footage, screenshots, and other media from third parties remain the property of their respective owners. While OtzTones may review, comment on, or reference such materials, we do not claim ownership and we cannot guarantee the authenticity of screenshots or confirm whether they originate directly from official game footage. Our reviews and commentary are based on the materials presented, and all rights remain with the original creators.

3.2 Permitted Use

  • Users may view, stream, and share OtzTones content for personal, non-commercial use only.

  • Social media sharing of links is encouraged.

3.3 Prohibited Use
Users may not:

  • Modify, copy, distribute, resell, or exploit OtzTones content without permission.

  • Support through platforms like Patreon, Buy Me a Coffee, or subscriptions may be offered.

  • Contributions are voluntary and do not grant ownership or decision-making rights.

4.3 Affiliate Marketing

  • Affiliate links may be included, earning commissions if purchases are made.

  • These links will be identified for transparency.

4.4 Paid Content & Premium Access

  • Some content may be behind a paywall or offered as premium.

  • Redistribution or account sharing is prohibited.

5. DISCLAIMERS & LIMITATIONS

5.1 No Professional Advice

  • OtzTones content is for entertainment and informational purposes only.

  • It is not legal, medical, financial, or professional advice.

5.2 Service Disruptions

  • We do not guarantee uninterrupted service.

  • We are not liable for outages caused by third-party platforms (e.g., Twitch, YouTube, Spotify).

5.3 Limitation of Liability
To the fullest extent permitted by law, OtzTones and Celestino Solis are not liable for:

  • Losses resulting from reliance on OtzTones content.

  • Service disruptions, data loss, or damages caused by third-party platforms.

  • Issues arising from sponsors, advertisers, or external links.

6. WAIVER OF RIGHT TO SUE & DISPUTE RESOLUTION

6.1 Arbitration

  • By using OtzTones, you waive the right to sue in court. Disputes will be resolved through binding arbitration in Wisconsin, USA.

6.2 Class Action Waiver

  • You agree not to participate in any class-action lawsuits against OtzTones.

6.3 Exceptions

  • Intellectual property disputes and breaches causing irreparable harm may be pursued in court.

7. THIRD-PARTY LINKS & ADVERTISING

7.1 Third-Party Content

  • OtzTones may link to third-party sites or services.

  • We are not responsible for their content or privacy practices.

7.2 Advertising & Sponsorships

  • Sponsored content will be clearly disclosed.

  • We are not liable for issues with purchases made through third-party links.

8. CHANGES TO TERMS

  • Updates take effect upon posting to our website.

  • Continued use of the Services means you accept the updated Terms.

9. TERMINATION OF SERVICE

9.1 Right to Terminate
